1. Acceptance of Terms

By downloading, installing, or using the Progressive Pomo application ("App") or visiting our website at progressivepomo.com ("Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

These Terms constitute a legal agreement between you ("User", "you") and Raji's Lab ("we", "us", "our"), the developer of Progressive Pomo.

2. Description of Service

Progressive Pomo is an adaptive focus timer application that uses progressive overload to help users build concentration capacity over time. The service includes:

  • Adaptive progressive Pomodoro timer with focus rating system
  • Smart adaptive break algorithm (30 seconds to 30 minutes)
  • Project-based focus tracking with in-session todos
  • Sequential rituals (timed routine builder)
  • Growth analytics, achievements, and level progression
  • Focus sounds and ambient music library
  • Multiple timer faces and standby mode
  • The progressivepomo.com website and related web pages

3. User Eligibility

You must be at least 13 years of age to use the App. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. The App does not knowingly collect personal information from users, as it operates primarily offline.

4. User Accounts

The core App does not require user registration or accounts. All data is stored locally on your device. Optional cloud features (available to Pro and Pro+ subscribers when launched) may require Google account authentication solely for backup and synchronization purposes.

5. Free and Paid Subscriptions

5.1 Free Tier

The free version of Progressive Pomo includes the core adaptive timer, focus rating system, smart adaptive breaks, up to 3 projects, up to 3 rituals, basic analytics, achievements, free focus sounds, and 1 theme. Free features are subject to change, but we will not remove core functionality without notice.

5.2 Progressive Pomo Pro (₹249/month or ₹999/year)

The Pro subscription unlocks:

  • Up to 10 projects and 10 rituals
  • Unlimited focus sessions and full history access
  • Premium focus music library
  • 7+ beautiful themes including OLED-optimized dark modes
  • Advanced timer customization
  • Google Drive backup (when available)
  • B.R.I.O. AI assistant access (when available)
  • Email support

5.3 Progressive Pomo Pro+ (₹499/month or ₹3,499/year)

The Pro+ subscription includes everything in Pro, plus:

  • Unlimited projects, rituals, sessions, and todos
  • All premium music tracks and all themes with custom colors
  • Advanced analytics and insights
  • Early access to new features
  • Daily automatic backups (when available)
  • Advanced B.R.I.O. AI features (when available)
  • Multi-device real-time sync (when available)
  • Priority 24-hour support

5.4 Features Marked "Coming Soon" or "When Available"

Certain features — including B.R.I.O. AI assistant, Google Drive backup, and multi-device sync — are currently under development and are not yet available. These features are listed as planned additions and are not guaranteed to be delivered by a specific date. We will make reasonable efforts to deliver them and will notify subscribers when they become available. You are subscribing for the features currently available at the time of purchase.

6. Billing and Payments

6.1 Payment Processing

All subscription payments are processed through Google Play. We do not directly collect, process, or store your payment information. By purchasing a subscription, you also agree to Google Play's Terms of Service.

6.2 Subscription Renewal

Subscriptions automatically renew at the end of each billing period (monthly or annually) unless cancelled at least 24 hours before the end of the current period. The renewal charge will be applied to your Google Play account.

6.3 Cancellation

You may cancel your subscription at any time through your Google Play Store account settings (Google Play → Menu → Subscriptions → Progressive Pomo → Cancel). Upon cancellation:

  • You retain access to Pro/Pro+ features until the end of your current billing period
  • After the billing period ends, your account reverts to the Free tier
  • Your local data (projects, rituals, sessions) is preserved — you may lose access to projects/rituals beyond the Free tier limits, but the data is not deleted

6.4 Refunds

We offer a 7-day money-back guarantee. If you are unsatisfied within the first 7 days of your subscription, contact us at support@rajislab.com and we will process a full refund. Refunds are processed via Google Play.

If you experience a genuine issue beyond 7 days, you are welcome to reach out at support@rajislab.com - we review all requests personally and will do our best to help.

6.5 Price Changes

We reserve the right to change subscription prices. Existing subscribers will be notified at least 30 days before any price increase takes effect. You may cancel before the new price applies.

7. Acceptable Use

You agree not to:

  • Reverse engineer, decompile, or disassemble the App
  • Modify, adapt, or create derivative works based on the App
  • Distribute, license, lease, sell, or resell the App
  • Use the App for any illegal or unauthorized purpose
  • Attempt to circumvent subscription restrictions or access paid features without a valid subscription
  • Interfere with or disrupt the App's functionality or servers
  • Submit false or misleading information through the Website contact form
  • Use automated tools to scrape or access the Website

8. Intellectual Property

The Progressive Pomo App, Website, and all associated content — including but not limited to logos, design, text, graphics, icons, images, audio, software code, and the "Progressive Pomo" and "B.R.I.O." names — are the exclusive property of Raji's Lab and are protected by applicable intellectual property laws.

The "Progressive Pomodoro" method and associated terminology as used within this App are descriptions of the App's methodology and do not claim ownership over the general Pomodoro Technique concept.

9. User-Generated Content

Content you create within the App (project names, todos, ritual configurations) is stored locally on your device. We do not access, own, or claim any rights to your personal focus data. If you use the contact form, feedback, or reviews, you grant us a non-exclusive right to use that feedback for product improvement.

10. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we handle (and don't handle) your data. The Privacy Policy is incorporated into these Terms by reference.

11. Disclaimer of Warranties

The App and Website are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties that the App will be uninterrupted, error-free, or free of harmful components
  • Warranties regarding the accuracy or reliability of any results obtained through the App

Progressive Pomo is a productivity tool. It is not a medical device, therapy, or treatment for any condition including ADHD, anxiety, or other health conditions. Consult a healthcare professional for medical advice.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Raji's Lab shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of data (all data is stored locally — please maintain your own backups)
  • Loss of profits or revenue
  • Interruption of service
  • Cost of substitute services

Our total liability for any claim arising from these Terms or the use of the App shall not exceed the amount you paid to us in the 12 months preceding the claim, or ₹999 (whichever is less).

13. Indemnification

You agree to indemnify and hold harmless Raji's Lab, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses arising from your use of the App or Website, or your violation of these Terms.

14. Termination

We reserve the right to terminate or suspend your access to the App or any paid features at any time if you violate these Terms. Upon termination:

  • Your license to use the App is revoked
  • If you have an active subscription, we will provide a prorated refund for the remaining period
  • Your locally stored data is not affected (it remains on your device)

You may terminate your use at any time by uninstalling the App and cancelling any active subscriptions.

15. Third-Party Services

The App and Website may interact with third-party services:

  • Google Play: For app distribution, subscriptions, and billing
  • Google Drive: For optional cloud backup (when available)
  • Google Analytics: For website traffic analysis
  • Firebase: For push notifications (admin use only)

Your use of these services is governed by their respective terms and privacy policies. We are not responsible for third-party service availability or functionality.

16. Modifications to Terms

We may modify these Terms at any time. Material changes will be communicated through:

  • An in-app notification
  • A notice on the Website
  • An update to the "Last updated" date at the top of this page

Continued use of the App or Website after changes constitutes acceptance of the modified Terms. If you disagree with any changes, please discontinue use and cancel any active subscriptions.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be subject to the exclusive jurisdiction of the courts in India.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Raji's Lab regarding the use of Progressive Pomo and supersede all prior agreements, communications, and understandings.
